HFL Joint Lecture with WIPO on IPR Legislation and Practice

HFL & ECUPL Joint Lecture Introducing Legislation and Practice of IPR Criminal Enforcement to ECUPL students for the 2020 WIPO-CHINA Summer School on Intellectual Property

On September 22, 2020, HongFangLaw (HFL), jointly organized a lecture with the East China University of Political Science and Law (ECUPL), focusing on the protection of intellectual property rights and an introduction on the Legislation and Practice of IPR Criminal Enforcement to ECUPL students, during the “2020 WIPO-CHINA Summer School on Intellectual Property” event organized by WIPO and Chinese universities.

The Class was composed of master’s degree students from ECUPL University, willing to expand their knowledge of the IPR criminal enforcement in China. As always, good care was put into the preparation of the event, and more than half the attendees were present via video conference, to avoid crowding halls and classes with respect to the recent COVID regulations.

Mr. Xu Zhang, the founding partner of HFL with over 20 years of experience, was invited by the University as one of the guest lecturers for this event and took on the opportunity to introduce the best approach for the application of legislation and practice on the selected topic.

Mr. Zhang focused his attention mainly on introducing the students to the Criminal Enforcement area of IPR law, and on how the legislations implemented by the legal authorities best apply on certain scenarios, as well as the best practice on specific cases presented.

During the legislation section presentation, Mr. Zhang focused not only on the recent developments and overall evolution of the legislations in China but especially on current and alternative legislation applicable to IPR enforcement, on all Trademark, Patent, Trade secret, and Copyright cases.

For what concerns the Practice area, Mr. Zhang introduced the students to the different authority bodies that could get involved in the overall criminal process, during the investigation, arrest, and trial sections of a case. Most importantly, the speaker focused on the steps to take on how to deal with a criminal case properly, such as how to communicate with the different authorities and how the document collection should be handled.

To give more context to the students, Mr. Zhang gave a presentation on four separate cases that were most relevant in IPR criminal law in recent years, providing the students with valuable insights on how a case should be handled and successfully closed.

Finally, to conclude his lecture, Mr. Zhang moved the attention towards criminal procedural law, and on how to coordinate criminal and civil procedures for a brand owner.

The lecture ended successfully by a productive question-and-answers session with both onsite students and also online participants from other countries, and it is always a thrill to go back to a school and share what has been earned from years of experience to the students that are still learning theory knowledge in the campus. It is our privilege to be invited to the lecture with a very positive vibe.

We are pleased to see that ECUPL for which we at HFL have established a scholarship in 2017, the “HongFangLaw iMerit Scholarship”, is doing the best they can to support their students earning valuable knowledge with specific programs and international collaborations, such as the one with WIPO. We will together support the students in achieving their full potential and becoming successful lawyers in the years to come.
