HFL and the Italian Chamber of Commerce in China Webinar on Anticounterfeiting investigations – Report

On Wednesday, December 15th, we have been honored to be invited as speakers to introduce anticounterfeiting investigations for the members and associates of the Italian Chamber of Commerce in China (CICC), this event is part of their Intellectual property working group (IPWG) program, helping new and established businesses know more on how the Intellectual Property system works in China, and on how to better protect their portfolio. This webinar is co-organized with the CICC Mechanical Engineering Working Group (MEWG).

Mr. Federico Bartolini, from HongFangLaw, hosted a presentation to the audience on how to conduct an investigation to Protect your brand, providing through practical cases, suggestions on how to carry out an anti-counterfeiting investigation in a (cost) effective manner and which are the enforcement options once evidence material is collected.

Speaker:

The main topics of the presentation were:

  • Overview of the investigation process
  • Ways to a (cost) effective investigation
  • 4 Case Studies
  • Conclusions

Together with the other speakers Carlo Geremia, IPWG Coordinator, Carlo Nizia, MEWG Vice Coordinator, and Felice Meli, Partner and Head of anti-Counterfeiting operations, Ferrante IP, the event focused on how to navigate trademark Infringement & Counterfeiting, the CICC Intellectual Property Working Group (IPWG) welcomed over 40 companies to the webinar.

Often foreign companies are caught off-guard on how to react to squatters and counterfeiters. The IP experts provided suggestions on how to carry out an anti-counterfeiting investigation in a (cost) effective manner and the remedies available for companies and especially SMEs. Prevention instead of a mere reaction upon infringement is the key to ensuring IP protection of your brand.

HFL team member Federico Bartolini closed his remarks with a quote:

“The burden of proof can be a significant hindrance in any legal case in China, conducting an effective investigation will be a way to secure important evidence which can get the government authority’s support from an early stage, and help finalize a case with a positive outcome.”
